Toby Terms of Use

1. What Toby Is
Toby is a digital tool powered by artificial intelligence (AI) that helps Master Plumbers members access a range of documents relevant to the PGD industry. These include technical Standards documents, legislation, regulations, building codes, and other industry reference material – but this is not an exhaustive list, and the content available in Toby may change over time. 
Master Plumbers may update, add, or remove documents from Toby at any time and without prior notice. While we aim to ensure all documents are the latest available versions, we manually check with providers to spot updates. We’ll do our best to keep documents current but can’t guarantee they’re always the latest version.
All output in Toby is generated by an AI tool rather than reproducing any original work or content. While efforts are made to ensure accuracy, the content may contain errors or omissions and should not be considered authoritative. Users must verify all information before relying on it.

2. Who Can Use Toby
Only current Master Plumbers members with a licence can use Toby. Your access is a licence to use the tool — not ownership. You can’t copy, share, or sell the tool, its code, or any part of it.
Toby is currently licensed for up to 200 registered members. Access to Toby is restricted to New Zealand; it cannot be accessed from overseas, including through a VPN. We may suspend or terminate your access if we reasonably suspect your login is being shared outside your business or accessed from outside New Zealand.

3. What Toby Does With Your Questions
You can ask Toby questions verbally or in writing. Toby will then search all the documents in its database to find the most relevant information for you.
Toby does not keep a record of your questions or its answers once your session ends – everything is wiped at that point and is not saved or reused. This is a condition of our licence with Standards NZ. 
We may still collect some general usage data (see ‘Data and Privacy’ below) to manage your account and meet our reporting obligations to Standards NZ.

4. Checking the Results
Toby’s answers are not authoritative and should always be checked against the original Standard, regulation, or code before you rely on them – particularly for compliance, certification, or safety decisions. Toby will usually show you the source so you can check it yourself.

5. AI Limitations
Toby is built on AI technology, which means it can occasionally misunderstand a question, miss relevant content, or generate an answer that sounds confident but is incorrect (sometimes called ‘hallucination’). Toby only draws on the specific licensed documents in its database – it cannot answer questions outside that scope and won’t search the wider internet. Toby is an emerging AI product and is being improved over time – members may experience changes, updates, or occasional errors.

6. No Guarantees or Liability
We do our best to keep Toby accurate and running smoothly, but we can’t promise it’ll always be error-free or available. Master Plumbers isn’t responsible for any loss, cost, or damage from using Toby or relying on its results. Use it at your own risk.
You agree to indemnify Master Plumbers against any loss, claim, or liability arising from your misuse of Toby, including sharing your login, attempting to access Toby from outside New Zealand, or relying on Toby’s output without checking the original source. 
In plain terms: if you misuse Toby and it causes a problem, that’s on you – not us.

7. Paying for Toby
Toby is free for the trial period which ends 9 June 2027. After that, Master Plumbers will sort out what comes next with Standards NZ and let you know if the service is continuing and what it might cost. Continuation isn’t guaranteed – it depends on funding and our licence being extended.

8. Data and Privacy
We collect some data from how your business uses Toby – such as login activity and query volumes. We protect this data under the Privacy Act 2020 and take reasonable steps to keep it secure.
We may also be required to report general usage figures (such as number of users and query volumes) to Standards NZ and Standards Australia, as a condition of our licence to provide Toby. This does not include the content of your queries.

9. Fair Use
Toby is for legitimate business use by members only. Don’t share access, use it for scraping data, or interfere with the system.

10. Intellectual Property
Standards documents
All rights in Toby are owned by Master Plumbers. A specific licence is provided by Standards NZ and Standards Australia allowing Master Plumbers and Toby to access all relevant Standards documents.
Copyright in the standards contained within TOBY is owned by Standards Australia Limited and the Crown, administered by the New Zealand Standards Executive through the Ministry of Business, Innovation and Employment. These are reproduced and adapted with permission under licence number LN001534.
All other documents
All other documents are sourced from third-party suppliers and provided to members at no charge. Master Plumbers makes no warranty as to the licensing status of those documents.

11. Changes to Access Rules (EULA)
Standards NZ or Standards Australia may introduce additional terms that you’d need to agree to in order to keep using Toby. If that happens, we’ll let you know.

12. Service Availability and Termination
We may occasionally take Toby offline for updates or maintenance, and may retire or discontinue it entirely. We’ll try to give reasonable notice where possible, but sometimes downtime happens without warning.

13. Ending Access
We can suspend or end your access if terms are breached or misuse occurs. You can cancel your access at any time by contacting us.

14. Updates to These Terms
We may update these Terms from time to time. Continued use means you accept the new terms.

15. Governing Law
These terms are governed by New Zealand law, and any disputes will be handled by New Zealand courts.
